Professor Paul Roberts, University of Nottingham Although it is often accepted that rationale-based defences to criminal liability can be justificatory or excusatory, disagreements about how best to conceptualise the categories of justification and excuse have appeared so interminable that some theorists argue that they should be abandoned altogether. This book offers a novel, principled, and intuitively appealing conceptual account of the natures of justifications and excuses, showing how they differ, and why the distinction between them matters. The monograph breaks new ground by defending a model of rationale-based defences that turns solely on the quality of the defendant's reasoning. Abstract

The notion of fundamental rights is one of the most important topics of our times. Strident controversies concerning the content of fundamental rights have increased worldwide, sometimes degenerating into violent conflicts. Yet legal and political theorists have so far paid insufficient attention to these controversies. This collection of essays by internationally renowned scholars is a salutary first step in the direction of resolving these disputes. The essays discuss many urgent problems concerning fundamental rights, including how such rights can be philosophically explained; how fundamental and human rights are related; how fundamental constitutional rights protecting minorities from oppression can be justified; and how constitutional human rights provisions can be implemented and applied. The authors hope to contribute to solving the disputes on fundamental rights through intellectual consensus rather than violence.

Abstract

This book develops a novel account of the connections between justification, understanding, and knowledge. It lays the foundation for a more systematic and interconnected treatment of these central notions in epistemology. The author's key move is to show first that a specific conception of doxastic justification constitutes our best point of entry into questions pertaining to a subject's ability to secure understanding of reality. Second, that the traditional order of analysis when it comes to the connection between understanding and knowledge should be reversed: knowledge itself is best conceived of in terms of a specific type of understanding. Rational Understanding will appeal to scholars and advanced students working in epistemology and philosophy of science.
